Privacy policy

This privacy policy (hereinafter referred to as ‘Policy’) of the Kūrybinės Jungtys association (hereinafter referred to as the ‘Association’ or ‘we’) defines the processing of the personal data of the Association’s members, clients and partners, their representatives, other persons connected with our activities, website visitors and candidates for membership in the Association (hereinafter referred to as ‘You’).

The controller of your personal data is the Association, i.e. the association Kūrybinės Jungtys, legal entity registry No. 303469454, registered office address M. K. Čiurlionio g. 1-64-65. Your personal data is processed by the Association in accordance not only with this Policy but also with the General Data Protection Regulation, the Law on Legal Protection of Personal Data of the Republic of Lithuania, the Law on Electronic Communications of the Republic of Lithuania, and other applicable legal acts, as well as with the instructions and recommendations of supervisory authorities.

In processing your personal data, the Association complies with the principles applicable to the processing of personal data, i.e. lawfulness, fairness, transparency, purpose limitation, minimisation of the scope of the processing and duration of the retention of the data, accuracy, integrity and confidentiality of the data, as well as ensuring the establishment of effective measures to ensure data security.

The Association shall publish this Policy on its website when it is updated.

Purposes of processing your personal data

Your personal data is processed by the Association for the following purposes:

  1. For the purpose of providing services and/or entering into partnerships

The Association processes the personal data of its clients, programme participants, partners (and any and all of their representatives) for the purpose of concluding and performing contracts. The Association provides its services and implements its programmes and partnerships through contracts. The Association may also process relevant personal data of contractors (or their representatives) in order to comply with legal requirements applicable to us.

For this purpose, way may process the following personal data:

  • Personal identification data (name, surname, date of birth etc.);
  • Contact details (phone number, email address etc.);
  • Data about the data subject’s relationship with legal entities (position in the company represented etc.);
  • Data about the employees of the organisation with which you are cooperating or for which you are providing services, and other persons associated with the organisation in question;
  • Other data provided by you and/or necessary for the proper provision of the Association’s services, programmes or partnerships.

The processing of your personal data referred to above is limited to the extent necessary in order for us to ensure the proper provision of our services, implementation of our programmes and partnerships, or the proper performance of applicable legal obligations established by law.

Your personal data processed for this purpose may normally be retained by the Association for up to 10 years after the execution of the contract, unless the applicable legislation provides for different retention periods, or unless longer retention of your personal data is necessary in order to protect the rights and interests of the Association (or other persons).

  1. For the purpose of cooperation with service providers (creative professionals)

In its operation, the Association may use the services of creative professionals, artists and/or other service providers to ensure the smooth delivery of services and implementation of programmes or partnerships. Accordingly, the Association may process the following personal data for the purpose of concluding contracts with such persons (or their representatives) or for the performance of contracts already concluded:

  • Personal identification data (e.g. name, surname, date of birth etc.);
  • Contact details (e.g. telephone number, email address etc.);
  • Details regarding the professional experience, skills etc. of the creative professional, artist or other service provider;
  • Other data necessary for the Association to enter into contracts with the relevant persons.

This processing of your personal data is limited to the extent necessary for the purposes of cooperating with you and complying with any legal obligations to which we are subject.

The aforementioned personal data shall normally be retained by the Association for up to 10 years from the date of execution of the contract, unless applicable law provides for different retention periods, or longer retention of your personal data is necessary for the protection of our (or other persons’) rights and legitimate interests.

  1. For the purpose of admission into membership of the Association

We process the personal data you provide to us in the membership form as part of our new member admission process and our regular operation.

The Association processes your personal data necessary for the performance of its activities in order to comply with the legal requirements and to carry out the activities established in the Association’s Articles of Association.

In all cases, the Association shall process your personal data only to the extent necessary to ensure your admission into the membership of the Association, the management and administration of the Association’s activities, and the proper performance of its obligations under the law.

Your personal data will normally be kept until the date of termination of your membership at the Association, except where specific retention periods are established by law. In addition, the Association has the right to retain your personal data for a longer period of time in cases where it is necessary in order to protect our (or other persons’) rights and legitimate interests.

  1. For the purpose of publicising the activities of the Association

We may send you various e-mails, news items related to our activities, and offers pertaining to cooperation and/or participation in certain projects.

We may send such electronic communications to our customers (e.g. organisations involved in the implementation of the programmes) unless they have expressed a prior objection to the sending of direct marketing communications.

You can also subscribe to the Association’s e-newsletters. In such case, we will process your personal data for this purpose on the basis of your consent (which you express by subscribing to the newsletter).

In all cases, you have the right to opt out of such information being sent to you. You may do so by contacting the Association by email at labas@kurybinesjungtys.lt.

For the purpose of publicising the Association’s activities, your personal data may be retained for up to 3 years, unless you object to the processing of your personal data for this purpose before the end of this period.

  1. For the purpose of applying to become a service provider (creative professional)

The Association processes your personal data if you provide information about yourself in order to join the Association’s activities as a service provider (creative professional), and by filling in the creator form on our website, or by otherwise contacting us.

For this purpose, the Association processes your personal data on the basis of your consent expressed via providing us with the relevant information.

The period of retention of the data you provide depends on the Association’s need to cooperate with the relevant creative professional and/or other service provider. The normal retention period of such personal data is 3 years. If you withdraw your consent, we will stop processing your personal data.

When you apply to become a creative professional or voluntarily submit information about yourself, we would like to ask you to comply with at least the minimum data protection requirements and not to provide excess information about yourself other than what is relevant to your application and introduction.

  1. For the purpose of managing your enquiries

We also process your personal data when you contact us by phone, email or any other means of enquiry. For this purpose, we process the personal data you provide in order to properly administer your enquiries and to provide you with information about us. We therefore ask that you to not provide excessive personal data when making enquiries other than what is necessary for the processing of your enquiry.

Please note that, if necessary, the personal data provided by you may also be processed in order to comply with legal requirements or to protect the interests of the Association. 

In above cases, we process your personal data on the basis of the legitimate interests of the Association.

The normal retention period for the personal data you provide is up to 3 years, but this may change depending on the content, nature and other circumstances pertaining to the personal data you provide. In addition, we may retain the personal data you provide for a longer period in cases where it is necessary to protect the rights and legitimate interests of the Association (or other persons), to investigate a complaint or to resolve a dispute, and in other cases established in the applicable legislation.

When you visit our website, we may use cookies and/or other similar technological solutions to process your IP address and other network data you provide.

Cookies are small files (data files) that are sent to the web browser you use and stored on your device (computer, phone etc.). They allow our website to remember your actions, preferences, transactions and other actions performed on our website. Cookies are transferred to your computer on your first visit to our website.

Recipients of your personal data

In the course of our activities, we may use service providers to whom certain types of your personal data may be transferred. However, we only transfer your personal data when, and to the extent that, it is necessary for the provision of the relevant services. 

Your personal data may also be transferred to other recipients, such as state authorities, registers, lawyers, auditors, other third parties who are involved in the Association’s activities and/or who have legal grounds to receive your personal data.

When transferring your personal data, we make every effort to ensure that the legal requirements for the lawful use and retention of personal data are met.

Your rights as a data subject

As a data subject, you can exercise the following rights:

  1. Access your personal data and learn about how it is being processed;
  2. Request the rectification of incorrect, inaccurate or incomplete data;
  3. Request the erasure of your personal data in case of certain circumstances established by law (e.g., when personal data are being processed unlawfully, the basis for processing has ceased to exist, or in other cases);
  4. Request the restriction of the processing of your personal data under certain circumstances established in legislation (e.g., when personal data are being processed unlawfully etc.);
  5. Request to have your personal data transferred to another controller or directly provided in a form that is convenient for you, if we are processing them with your consent and by automated means;
  6. Object to the processing of your personal data being processed on the basis of legitimate interests, unless there are legitimate grounds for such processing or for the establishment, exercise or defence of legal claims;
  7. Withdraw your consent to the processing of your personal data if your personal data are processed on the basis of your individual consent.

In order to exercise the above-mentioned rights or if you believe that we are processing your personal data unlawfully or in violation of your rights, we recommend that you contact the Association immediately in writing by email at labas@kurybinesjungtys.lt or by post.

Please note that your request must be made in legible, understandable writing. It must include your name and contact details from which we can identify you. The request must clearly indicate which of your rights as a data subject you wish to exercise and to what extent.

Upon your request, our representative will inform you of the action taken by the Association in response to your request no later than 30 calendar days from the date of receipt. The time limit may be extended to up to 90 calendar days depending on the complexity of the request and the number of requests submitted to the Association by other persons. If the Association decides to extend the time limit for the processing of the request, our representative will inform you and explain the reasons for the delay, as well as provide you with information regarding your right to lodge a complaint with the State Data Protection Inspectorate.

In all cases, you have the right to lodge a complaint with the State Data Protection Inspectorate (for more information on how to lodge a complaint and contact details, please visit www.vdai.lrv.lt). However, we always recommend that you contact us first so that we can resolve your problem as quickly as possible in a mutually satisfactory manner.
